Generally three years from the date of the injury (M.G.L. c. 260, § 2A), and three years from the date of death in a wrongful death case. Claims involving a city, town or state agency are much shorter — the Massachusetts Tort Claims Act requires written presentment within two years. Do not wait to find out which applies to you.

The short version: someone owed you a duty of care, they breached it, and that caused you a real injury. The only way to know for certain is to have someone look at the specifics. That is what the free consultation is for, and we will tell you honestly if we do not think you have a claim.

Not before you have talked to an attorney. Adjusters are trained to ask questions that minimize your claim, and a recorded statement given while you are medicated or still in shock is very difficult to walk back later.

Most injury cases settle without a trial. That said, insurers pay more when they believe a firm will actually try the case, so we prepare every matter as if it is going to trial. If a fair settlement is not offered, we are prepared to file.

You can still recover. Massachusetts uses modified comparative negligence (M.G.L. c. 231, § 85): as long as you were not more than 50% at fault, you recover, with your award reduced by your share. Insurers push hard to inflate your percentage, and pushing back is often worth a great deal.

No. Massachusetts injury and workers’ compensation protections apply regardless of immigration status. You are entitled to medical care and to bring a claim, and everything you tell us is confidential.

It depends mostly on your medical treatment. We generally do not settle until your condition is stable enough for a doctor to speak to permanence, because settling early risks leaving future costs uncovered. Simple cases can resolve in months; serious injuries take longer, deliberately.
